Terms and conditions

These terms govern your use of the Genima website, the Genima web app and the Genima Android app (together, the "Service"). By creating an account or using the Service you accept them. If you do not agree, please do not use the Service.

1. Who provides the Service

Genima is provided by Alejandro Acho. You can contact him by email at contact@genima.art or through the contact form.

2. The Service

Genima lets you create images and videos with artificial intelligence: generating images and videos from a text prompt or from an image, editing tools (such as upscaling, restoration, background removal, expanding, inpainting and face swap), avatars, lip-sync and character videos, and personal styles trained on your own photos. It also includes a community gallery where you can share the creations you make public.

The models are developed by third parties (for example FLUX, Imagen, Veo, GPT Image, Sora, Seedream, Seedance, Kling, Hailuo, Recraft, Ideogram or Grok Imagine) and run through infrastructure providers such as FAL and Hugging Face. The catalogue of models and tools changes over time: models and tools may be added, updated or withdrawn, and a model may be temporarily unavailable.

3. Your account

You must be at least 14 years old and provide accurate information when you sign up. If you are under 18, you need the permission of a parent or guardian to buy tokens.
One account per person. Creating several accounts to collect free tokens is not allowed.
You are responsible for keeping your password confidential and for the activity carried out with your account. Tell us if you suspect unauthorized access.
You can delete your account at any time from your account page.

4. Tokens and prices

Generations and tools are paid for with tokens. The cost of each model and tool is shown in the app before you start; the cost charged is the one shown at that moment. Costs may change over time. The "Sketch" model is free while it is available.
New accounts receive free welcome tokens, once per email address. In the Android app you can also earn tokens by watching rewarded ads; the reward is shown in the app.
You can buy token packs (1 token = $0.01). Prices are in US dollars and the payment is processed by Stripe:
- $1 for 100 tokens
- $5 for 500 tokens
- $10 for 1,000 tokens
- $20 for 2,000 tokens
Tokens do not expire, can be used with any model or tool, have no cash value and cannot be transferred. They are not refundable, except where consumer law requires it.
If a generation fails on our side or at the model provider, the tokens it cost are returned to your balance.
If you delete your account, any tokens left in it, including purchased tokens, are lost.

5. Content rules

You must not use the Service to create, upload or share content that:

is sexual or pornographic, or sexualizes, exploits or harms minors in any way;
shows a real person without their consent, or uses someone's face or voice (for example with face swap, avatars or lip-sync) to deceive, impersonate, harass or defame them;
promotes hatred, harassment, intimidation or violence against any person or group;
is presented as real in order to mislead others (for example, fake news or fake evidence);
is illegal, or infringes the copyright, trademarks, image rights or privacy of others.

Only upload photos and audio of yourself or of people who have given you permission, and that you have the right to use. You must also respect the usage policies of the providers of the models you use.

Prompts and uploaded images are checked automatically and may be rejected. We may remove content that breaks these rules, and restrict, suspend or close the accounts responsible, without notice in serious cases. You can report content and block other users from the gallery.

You also agree not to:

bypass the content filters, rate limits or other technical restrictions of the Service;
attempt to access other users' accounts or private content, overload or disrupt the Service, or access it through automated means other than the apps we provide;
upload files containing malware.

6. Your content

You keep whatever rights you have over your prompts, the files you upload and your creations. Genima does not claim ownership of them. Content generated by AI may not be protected by copyright, and similar results may be generated for other people.
You grant us the permissions needed to store, process and show your content in order to provide the Service, as described in the privacy policy.
When you make a creation public, you also allow us, free of charge and for as long as it stays public, to show it in the community gallery, on your profile and as an example on the Genima website and in its promotion. You can make it private or delete it at any time.
You are responsible for how you use your creations and for making sure you have the rights needed to use them, including any conditions set by the provider of the model that generated them.

7. Storage and deletion

Your creations are stored while your account exists. You can download them and delete any of them at any time: deleting a creation removes it from your gallery and from our storage. Deleting your account removes all your creations, uploads and personal styles. Files you upload as input for a tool are deleted automatically a few days after you upload them. Copies in backups are deleted as those backups are rotated out. The privacy policy explains the details.

8. AI results

AI models can produce inaccurate, unexpected or unwanted results, and we cannot guarantee that a result will match what you asked for. Review your creations before using or sharing them.

9. Availability

We work to keep the Service available, but we cannot guarantee that it will be uninterrupted or error-free: it depends on third-party providers, and we may carry out maintenance that temporarily interrupts access. Download the creations you want to keep.

10. Liability

To the extent permitted by law, we are not liable for indirect damages or loss of profits, for the content that users create or upload, or for interruptions or errors caused by third parties or force majeure. Nothing in these terms limits liability for intent or gross negligence, or the rights that consumer protection law grants you and that cannot be waived.

11. Termination

You can stop using the Service and delete your account at any time. We may suspend or close your account if you breach these terms. If we discontinue the Service, we will give reasonable notice so that you can use your tokens and download your creations.

12. Privacy and cookies

The privacy policy explains how we process your personal data. Google Analytics is only used on the public website and only if you accept it in the cookie banner.

13. Changes to these terms

We may update these terms to reflect changes in the Service or the law. We will publish the new version on this page with its date and, if the changes are significant, let you know in advance by email or in the app. If you continue to use the Service after they take effect, you accept the new terms.

14. Governing law and jurisdiction

These terms are governed by Spanish law. Any dispute will be submitted to the courts that are competent under that law; if you are a consumer, those of your place of residence. This does not deprive you of the protection granted by the mandatory consumer law of the country where you live.
